1. Scope of activity
These general terms and conditions are valid for all business relations between Bracco s r.o. and its customers always in the version applicable at the time of entering into a contract.

2. Entering into a contract
Presentation of our range of goods in our e-shop does not represent an offer under commercial law. Such an offer is not binding. Customer is invited to make an offer to purchase contract through our e-shop. Contract is not entered through sending out of customer orders. Customer will receive confirmation of his/her order reception through e-mail (order confirmation). This order confirmation does not represent acceptance of the offer but it only informs customer that his/her order has been received by Bracco,s.r.o. company.
Contract with Bracco s r.o. is entered at the moment, when Bracco s r.o. company accepts the customer offer by confirmation in following e-mail. For the purposes of processing a purchase contract this contract will be deposited with the Bracco s r.o. company. Such purchase contract will be, apart from the sent confirmation about despatch, accessed to the customer only if the customer proves a special reason for resending of this contract.
Sale of offered goods is possible only in usual amount for domestic consumption and only to persons with legal capacity. Company Bracco s r.o. reserves the right to refuse received questions on orders for both technical and economical reasons.

Right of withdrawal
You have the right to withdraw from the contract in written form (e.g. letter, fax, e-mail) without specifying a reason during the time period of 14 days, which begins at the moment of this instruction reception in written form but not before taking-over of the delivered goods by its recipient. To keep this appeal period it is sufficient to send your written withdrawal or delivered consignment in time.

The right to withdraw from the contract is excluded for the goods which has been produced on a special customer wish (e.g. personal dog collars) and also for perishable goods.

Consequence of contract withdrawal
In case of effective contract withdrawal it is necessary to return received performance and also benefits from them (e.g. Interests) .on both sides. We ask you to inform us about your valid bank account in case you have not sent it to us yet. In case you cannot return the received consignment to us and the benefits from that(e.g. benefits arising from the use) or return to us its parts or you will return it in a worsen condition, you are obliged to compensate their value. You are obliged to provide compensation for the worsen state of goods and for the benefits received only when benefits and worsen state of the goods arose during manipulation with the goods byond the verification of its features and functionality. The term "verification of the features and functionality" means testing the goods , which is possible and usual in shops when buying goods.
Goods, that are possible to send back in a parcel are necessary to be sent on our risk. We ask you not to send returned goods at the expenses of Bracco s r.o. company. Liabilities to the money refund must be fulfilled within 30 days. This period begins for you at the moment of your contract withdrawal despatch or at the moment of the goods despatch, for us at the moment of their (withdrawal/thing) reception.

3. Arrangements for costs payment
Should you use the right to withdraw from the purchase contract, you are obliged to carry all the costs of the return shipment.

4. Warranty and liability for defects
To all defects on the goods occurred during the statutory warranty period you can apply legal requirements for defects removal or replacement of goods according to your choice . Under existence of a special legal requirements you can claim also a reduction of the purchase price or contract withdrawal and in addition to that you can claim also compensation for any loss, including compensation of loss instead of performance, as well as reimbursement of your costs incurred in vain. It is possible to apply the right of set-off claims or reduction of the price only if the counterclaims have been legally estabilished, are undisputed or have been accepted by us in writing. Length of the limitation period for the provision of legal claims in case of defective goods is 2 years. If goods are delivered with obvious defects in material or with obvious defects caused during production, please, contact our customer service.

5. Prices, postage and packing
Valid are the prices stated at the moment of the order. The validity of our time-limited offers is to be found at the place of their presentation in our e-shop. All the stated prices include already the valid legal value added tax. The prices for our customers in Switzerland are stated different from this rule, as VAT is not included and neither German nor Swiss statutory VAT will be credited for them. Potential VAT , that must be collected according to the Swiss law, will be set at the border by Swiss tax administration and it will be paid by the customer upon delivery.

In principle no additional rebate applies to the goods in action!

Postage prices for dealers, trainers and breeders are exception. Following prices for transportation are valid for them:

If the delivery should, for technical or logistical reasons, take place in several stages, costs for postage and packing will be charged only once, of course.

6. Goods delivery
Bracco s r.o. will despatch ordered goods as soon as possible to the address written by the customer in the order.
We deliver duty-free within the EU. For deliveries to countries outside the EU, especially to Switzerland, customer pays eventual duty, taxes and other fees alone.
If it is not possible to deliver certain product and purchase contract cannot be entered, we reserve the right to offer you additional delivery of remaining product. You are not obliged to accept this offer. If you do not want to accept our offer, please, send us the product back to the following address.

7. Reservation of ownership
Goods remain the property of Bracco,s.r.o. until the complete payment of the price.

It is possible to make the payment for goods by bank transfer or PayPal.

12. Final provisions
Legal realtions arising from this contract between Bracco,s.r.o. and customers and legal relations related to them, including matters of validity and consequences of invalidity , is governed by the law of the Czech Republic with the exclusion of the UN law on the International Sale of Goods (communication No. 160/1991 Coll., United Nations Convention on Contracts for the International Sale of Goods – CISG).
